A Doctor's Dilemma: Race, Violence and Medicine

On July 7, 2016, Dr. Brian Williams was a trauma surgeon on duty in Dallas, Texas, when police officers were rushed into his emergency room with gunshot wounds. They were victims of a gunman who targeted white officers in a rally protesting police brutality. This incident and the deaths of two unarmed black people just days before urged Dr. Williams to speak out on the difficult topic of racial divisions in America. His press conference and media interviews that followed gripped the nation. On CNN, Dr. Williams said, “There are a lot of people talking at each other, talking over each other, trying to shout each other out. But I don’t see people truly listening to the other side. Until we are ready to do that, there probably won’t be any truly substantive change.”

I hereby acknowledge and confirm my participation in a film/television/internet project (the “Program”) currently entitled “Conversations” being produced by The Nantucket Project LLC (the “Producer”). For good and valuable consideration, receipt of which is hereby acknowledged, I agree as follows:

I hereby irrevocably grant to the Producer, its licensees, agents, successors and assigns, the right to record my photograph, likeness, and voice by any means (the results of which shall be deemed the “Recordings”) and to edit the same (in Producer’s sole discretion) and to use my name as written above, approved biographical materials, and the Recordings, as well as any approved photographs and/or other materials provided by me, in the Program and publicity for the Program, in any media now known or hereafter devised, throughout the world, in perpetuity. Any use for promotion in the Program poster or advertising for the Program (to the degree that I appear in them) must be approved in advance by me, with the exception that the Producer in its sole discretion may use the Recordings, my name as written above, approved biographical materials, approved photographs and/or other materials provided by me in the Program trailer.

I hereby represent and warrant that I have the right to grant the rights granted hereunder. I expressly release Producer, its agents, employees, licensees and assigns from and against any and all claims which I have or may have for invasion of privacy or any other cause of action arising out of the production and/or distribution of the Program or the Recordings. I acknowledge and agree that in no event shall I seek or be entitled to obtain injunctive or other equitable relief against Producer, the Program or the Recordings.

This Agreement shall not be subject to the jurisdiction of any union or guild and no additional payments, royalties or consents of any party are required in connection with Producer’s use of any of the rights granted herein.

This Agreement shall be construed in accordance with the laws of and shall be deemed to have been executed and fully performed in the State of New York, exclusive of conflicts-of-laws principles. This Agreement may not be terminated or revoked under any circumstances. This Agreement shall constitute a binding contract between the parties hereto and shall supersede any and all prior negotiations and communications, whether written or oral, with respect thereof. This Agreement may not be amended or modified except by an instrument in writing signed by the parties hereto.
